Terms and conditions
Between: Pocket Entertainment ("Company") and the Participating Referrer ("User") — These Terms and Conditions govern the User's participation in the Pocket Entertainment Referral Project for the Writer Benefit Program (WBP). By participating, the User agrees to the following obligations, payment schedules, and conditions.
1. Voluntary Participation and Scope
Participation in this referral project is entirely optional. The User is under no obligation to source or onboard writers for the Company. However, should the User choose to refer writers to the Pocket Entertainment platform on their own initiative, such referral activities shall be strictly governed by these Terms and Conditions.
If the User elects to participate, they agree to the following scope of activities:
Referral Link Usage: The Company shall provide the User with an exclusive, trackable referral link. To be eligible for any payouts, the Referee must use this link to promote the Writer Benefit Program (WBP) and track all onboarding.
Writer Sourcing: Searching for, selecting, and reaching out to high-quality writers capable of contributing to the WBP, and encouraging them to register with Pocket Entertainment.
Onboarding Support: Assisting referred writers in successfully publishing their audiobooks/series on the platform.
Quality Assurance: Ensuring that the content submitted by the Referee meets the specific qualifications for enrollment under the WBP, as specified at studio.pocketfm.com/earn and meets the content guidelines available at the platform.
Language Scope Restriction: The optional referral and service activities under this Agreement apply exclusively to English-language content and writers.
2. Referee Eligibility
To qualify for payouts, the referred writer ("Referee") must meet strict eligibility criteria.
Valid Referee Definition: A valid Referee is a writer who has never previously published any chapter on the Pocket Entertainment Platform prior to registering via the User's exclusive referral link.
Unlimited Referrals: There is no cap or limit on the number of valid Referees a User may refer and assist in onboarding for WBP.
Language Constraint: Payouts are exclusively applicable to English-language series written by Referees on the platform.
3. Consideration and Compensation Structure
The User shall earn payouts based on the milestones and contest bonuses achieved by their valid Referees.
A. Milestone-Based Payouts
Payouts are triggered when a Referee completes any of the following milestones for any English-language series.

Single Payout Rule (No Double-Counting): Each milestone payout is credited only once per Referee, regardless of how many series that Referee writes.
First Series Precedence: If a Referee has multiple series that reach the same milestone, the User will be paid based on the first series to achieve that milestone.
B. Contest Bonus Payouts
In addition to milestone payouts, the User is eligible for a bonus if a Referee wins a platform contest.
Trigger: A Referee wins a cash prize in any English-language series contest running on Pocket FM.
Bonus Amount: 20% (twenty percent) of the total cash prize won by the Referee.
Cap and Limitation: The contest bonus is credited only once per Referee and is strictly applied against the first contest the Referee wins. This bonus is independent of milestone payouts.
4. Payment Terms and Schedule
All financial disbursements to the User are subject to the following processing rules:
Minimum Payout Threshold: Consideration shall be due and payable only when the cumulative amount owed to the User is equal to or greater than USD 100.
Payment Timeline: Funds will be transmitted to the User's designated bank account during the first working week of the successive calendar month following the month in which a payout condition (milestone or bonus) is fully satisfied.
Taxes and Deductions: All payments are completely subject to applicable withholding taxes and statutory deductions as required by governing law.
5. General Provisions
Fraud and Abuse: Pocket Entertainment reserves the right to withhold payouts, suspend the User's referral link, or terminate this agreement immediately if it detects fraudulent activity, self-referrals, spamming, or manipulation of the word-count metrics.
Confidentiality: The terms of this payout structure, the referral metrics, and platform data are strictly privileged and confidential. The User shall not disclose these terms to third parties without prior written consent from the Company.
